In this statement, CHANCE reaffirms the fundamental role of democratic participation, freedom of expression, and judicial independence, while calling for a balanced and rights-based approach by public institutions in responding to criticism.

CHANCE Stands in Solidarity with Civil Society and Journalists in Romania

The CHANCE network expresses its solidarity with civil society organisations, journalists, media outlets, experts, and citizens in Romania who have recently been portrayed as acting against the justice system in a decision adopted by the Judges’ Section of the Superior Council of Magistracy.
Civil society and independent media play a vital role in a democratic society. Reporting on matters of public interest, highlighting institutional challenges, engaging in consultations, and expressing criticism about public institutions are all legitimate forms of democratic participation. These activities should not be framed as threats to the justice system or as attempts to undermine judicial independence.
Judicial independence is a cornerstone of the rule of law. At the same time, it must coexist with free-dom of expression, media freedom, civic participation, and the right to scrutinise public institutions. A balanced institutional environment requires that authorities respond to criticism in a proportionate and rights-respecting manner.
Publicly labelling journalists, civil society organisations, media outlets, and individuals as part of a “smear campaign” or “hybrid attack” risks creating a chilling effect on public debate. Such reactions may discourage legitimate scrutiny and weaken democratic engagement.
CHANCE therefore calls on Romanian institutions to protect judicial independence while fully respect-ing democratic principles, including freedom of expression, media freedom, and the essential role of civil society.
